How to cancel a Viva Gym membership in South Africa (2026): notice, fees, and what to do if they keep debiting you
Last checked: 1 November 2026. Lines marked ⚠️ were not on a live Viva Gym page that day. The website did not load, so the terms quoted here are the copy saved by the Internet Archive on 7 November 2024, and a few points (the fee amount, and what happens if you cancel after the 25th) are not spelled out there.
Who this guide is for
This guide is for anyone in South Africa with a membership at Viva Gym, the chain run by Viva Gym SA (Pty) Ltd (registration number 2011/129325/07). That includes a 12-month membership, a membership that has already run past 12 months, and people who think they have cancelled but still see a debit go off.
It is about the South African company only. VivaGym in Spain and Portugal (vivagym.com) is a different business. Its app cancellation and its "cancel by the 20th" rule do not apply to a vivagym.co.za contract. Do not use those forms or those dates.
It explains, in plain language, what Viva Gym's own published terms say, what the Consumer Protection Act (CPA) adds, and how to use your bank and the ombuds if things go wrong. Every key claim links to a public source so you can check it yourself.
⚠️ The live site did not load on 1 November 2026. <https://www.vivagym.co.za/> points at an Azure address that returns "Site Not Found", and the certificate does not match the domain. <https://app.vivagym.co.za/login/>, the login link on the archived homepage, timed out. The membership agreement below is the page archived on 7 November 2024, which is the latest snapshot. Read your own signed agreement as well. If the site comes back, check the live terms before you rely on a date or a fee.

Month-to-month vs fixed-term: what's the difference?
First work out which kind of membership you have. The published agreement does not use the words "month-to-month". It is one contract that continues until you or Viva Gym end it. The product that changes the fee is the 12-month membership option. Your start date and product are on the online application, in the welcome email, or under "My Details" in the members area.
| 12-month option, still inside the first 12 months | After those 12 months, or you did not choose the 12-month option | |
|---|---|---|
| Notice to cancel | The terms do not set a number of days. Section 14 of the CPA gives you 20 business days' written notice | In the members area. Before midnight CAT on the 25th: it ends at the end of that month. On or after midnight CAT on the last calendar day: it ends at the end of the following month |
| Cancellation fee | A cancellation fee will apply. The terms do not say how many rands, or how many months | No cancellation fee if you follow clause C 1.1. ⚠️ The "no fee" words sit on the before-the-25th sentence. See below |
| After 12 months | It does not end by itself. After the first 12 months, clause C 1.1 applies and the terms say no cancellation fee | It carries on until you terminate |
| Cooling-off | 7 days, not counting the day you accepted, and not counting Saturdays, Sundays and public holidays. Done in the members area. Full refund of everything they have received | The same window, only just after you join (or just after a not-yet-open gym opens) |
| Freezes | Not mentioned in the agreement ⚠️ | Not mentioned in the agreement ⚠️ |

The 25th, and the gap after it. Clause C 1.1 says two different things, and they do not meet in the middle:
- Cancel before midnight CAT on the 25th, and the agreement ends at the end of that month, with no cancellation fee.
- Notify them on or after midnight CAT on the last calendar day, and it ends at the end of the following month.
⚠️ The clause does not say what happens if you cancel after midnight on the 25th but before the last calendar day. For a 31-day month, that is the 26th to the 30th. Do not fill that gap yourself. If you are past the 25th, send notice the same day and ask for the end date in writing before you treat the membership as finished. A 2017 official Hellopeter reply described the 25th as the cut-off "so that you are not charged the following month." That reply is nine years old. It matches the first sentence. It is not a reason to ignore the second sentence. (Hellopeter, 11 May 2017)
Just joined? There is a cooling-off period in the contract. You get a full refund of all money they have received if you terminate in the members area within 7 days, excluding the start date, Saturdays, Sundays and public holidays. If the gym was already open, the 7 days run from the day you ticked the debit-order box (Step 3 of the online application), and that day itself does not count. If the gym had not opened yet, the 7 days run from the opening date, and the opening date does not count. (Section D)
⚠️ The FAQ shortens the pre-opening rule to "a money back guarantee for 7 days from when the gym opens" and does not mention weekends or public holidays. Use section D, not the FAQ sentence. (FAQ, archived 7 November 2024)
The Consumer Protection Act's own cooling-off right is narrower. Section 16 applies when the deal came from direct marketing (they approached you). It is 5 business days, and it is not a general "I changed my mind after I walked in and signed" right. If nobody marketed to you directly, do not rely on section 16. You still have Viva Gym's own 7-day refund above, if you are inside that window and you cancel in the members area.
On a medical aid or rewards plan? ⚠️ The published agreement does not mention Discovery Vitality, Momentum Multiply, or any other partner. Nothing in it says that cancelling the benefit cancels the gym. If a scheme sold you this membership, cancel with Viva Gym as well, and ask the scheme in writing what happens to the benefit.
Joined with someone else? The agreement says you cannot transfer it, and you may not let another person use your membership. The homepage has advertised bringing family when you sign a 12-month contract. ⚠️ It does not say that another person's membership ends when yours does. Cancel each membership in its own right. No one under 14 may be inside a Viva Gym. The FAQ says young people can join from 14. (Part 1, section A; FAQ)
Exact steps to cancel
- Find your details. You'll need your full name, ID or passport number, the gym you joined, whether you chose the 12-month option and when it started, and the bank account the debit order comes off. The welcome email has the members-area login. "My Details" in the members area is the address, mobile number and email the contract treats as your chosen address for notices.
- Check your timing.
- Inside the cooling-off window: cancel in the members area and say it is a section D cooling-off cancellation. Ask for the full refund.
- 12-month option, still inside the first 12 months: give 20 business days' written notice under section 14 of the CPA, and ask for the cancellation fee and the calculation. Weekends and public holidays don't count as business days.
- Past 12 months, or never on the 12-month option: cancel before midnight CAT on the 25th if you want it to end at the end of this month. If you are later than the 25th, send it anyway and get the end date confirmed. ⚠️ The terms do not explain the days between the 25th and the last day.
-
Cancel in the members area, and put it in writing as well. Clause C says you terminate via your members area at www.vivagym.co.za. The archived homepage's Login link went to app.vivagym.co.za/login. The archived contact page says you manage the membership yourself on "Viva Live!", using the welcome-email login or the forgot-password link. (Contact page, archived 16 September 2024)
Section E also accepts a written notice by email to [email protected], and through the Contact Us area on the website. Email is presumed received when you send it, unless they prove it was not. Use the email address they hold for you, and keep the sent copy.
Only if you cannot use the members area, the terms allow prepaid registered post to Ground Floor, Block D, Greenford Office Estate, Punters Way, Kenilworth, Western Cape, 7708. A posted notice is presumed received 14 days after posting, unless they prove otherwise. That delay matters: post early, and do not count the 14 days as if they had already received it.
⚠️ On 1 November 2026 the website and the app login did not load, so the members-area button could not be used from here. Email [email protected] the same day. If you still cannot get into the members area, send the registered letter as well, because that is the fallback the contract itself names. ⚠️ The terms and the FAQ do not publish a cancellation phone number. A 2017 official reply told a member who was still inside 12 months to ask the club manager for the early-cancellation fee. That is not a published call-centre number. (Hellopeter, 28 November 2017)
-
Ask for written confirmation. Ask for the effective end date, any cancellation fee and how it was calculated, the last debit date, and confirmation that each linked membership is included. The contact page, as archived in September 2024, said the contact form is answered within 2 working days. ⚠️ That promise was not re-checked on a live page. If you have heard nothing within about 5 business days, follow up in writing.
- Save everything. Keep the members-area screenshot, the sent email, the post office slip, the confirmation, and the names of anyone you spoke to. You will need these if you have to dispute a debit later.
- Pay what's legitimately owed up to the cancellation date. The monthly fee is payable in advance, by debit order on the first business day of the month, from the second month onward. Subject to the CPA, the terms say debit-order payments are not refundable. The joining fee is not refundable either, except where section D (cooling-off) applies. A single-gym membership ends automatically if that gym stops operating, with a pro rata refund of the monthly fee. ⚠️ That closure refund is only for a membership of a single gym. The old homepage marketed access to any Viva Gym. If yours is the nationwide product, do not assume a club closure ends the contract or produces a refund. Ask, and get the answer in writing.
- Only once cancellation is confirmed, ask your bank to stop (suspend) the mandate for future debits (see below). Don't use this step instead of cancelling. During the first 12 months of a 12-month option, returned debit orders can be handed to a debt collector, and if you stay in arrears Viva Gym says it may list you with credit bureaus.
The company's registered office, from the same agreement, is Mazars House, Rialto Road, Grand Moorings Precinct, Century City, Western Cape, 7441. That is the registered office. The address for a notice you cannot send online is the Kenilworth address in step 3.

Fees and notice, explained simply
Not on the 12-month option, or the first 12 months are already over. Clause C 1.1 is the route, and clause C 1.2 says that after the initial 12 months that route applies with no cancellation fee. Get the cancellation in before midnight CAT on the 25th and the terms say it ends at the end of that month. The monthly fee is collected in advance on the first business day, so the debit that has already gone off for this month is for this month. The terms say debit-order payments are not refundable, subject to the CPA. Do not expect a refund of the days you will not use, unless you are inside cooling-off or the single-gym closure rule.
12-month option, still inside the first 12 months. You can cancel. Clause C 1.2 says a cancellation fee will apply. It does not publish a rand amount or a formula such as "two months' fees". Do not pay a figure you have not seen calculated. Ask for the amount in writing and compare it with regulation 5 below. A November 2017 official reply said the club manager can give you that fee. ⚠️ The 2024 terms do not name the club manager, and they do not state the fee. (Hellopeter, 28 November 2017; clause C 1.2)
The contract does not stop at month 12. Part 2, section A says the agreement continues until it is terminated under section C. Viva Gym's May 2017 Hellopeter reply said the same thing in plainer words: 12-month contracts roll on until the member cancels. Cancelling the rollover is the clause C 1.1 process, and the terms say no cancellation fee is due at that point.
Joining fee. Payable up front by card or instant EFT. Not refundable, except the section D cooling-off refund of all money received. If you leave and later rejoin, clause C 1.3 says you pay the joining fee again.
Fee increase. Viva Gym can change the monthly fee and the administration fee, with one month's notice. If you do not want to pay the higher fee, you may terminate under section C. ⚠️ Section C still includes the cancellation fee if you are inside the first 12 months of a 12-month option. The increase clause does not say the fee is waived. Ask them to confirm that in writing before you treat the increase as a free exit.
Unpaid debit orders. An administration fee may be charged and taken off the same account. ⚠️ No rand amount is published. On a 12-month option, debit orders returned in the first 12 months can be handed to a debt collector. If the arrears continue, the terms say Viva Gym may "black-list" you with credit bureaus.
Freeze instead of cancelling? ⚠️ The membership agreement does not mention freezing. Do not stop the debit because someone at the club said the membership was frozen. Ask for the freeze, the fee, the length, and whether debits stop, in writing, and keep paying until you have that.
What the CPA says (section 14, plain English)
Section 14 of the Consumer Protection Act applies to fixed-term agreements with consumers (individuals, and some small businesses). The 12-month option is the fixed term in this contract. The ordinary clause C 1.1 cancellation, once any 12-month period is over, is the contract's own route and can be shorter than 20 business days. You do not have to wait 20 business days if the contract lets you end sooner and without a fee.
- You can cancel a fixed-term agreement at any time, for any reason, by giving 20 business days' notice in writing or another recorded form.
- You still owe anything due under the agreement up to the cancellation date.
- The supplier may charge a "reasonable cancellation penalty". Regulation 5(2) lists what decides "reasonable", including how much is still owed, how long the contract was meant to run, how much notice you gave, and normal practice in the industry. Regulation 5(3) says the penalty can't be so big that it cancels out your right to cancel.
- Before a fixed-term agreement ends, the supplier must remind you it's expiring (the Act says between 40 and 80 business days before). If you do nothing, the agreement continues month-to-month, which you can then cancel. ⚠️ Viva Gym's published terms do not say they send that reminder. They are written so the contract simply continues until someone terminates it.
- The Consumer Goods and Services Ombud (CGSO) has said gym cancellation penalties can reflect discounts or goods you received for signing a long contract. In one dispute it also found that future lost profit shouldn't be built into the penalty. That's an ombud view, not a court ruling, but it's useful if a fee looks excessive.

Still being debited? DebiCheck and bank steps
First, a key point: stopping the debit order at your bank does not cancel your contract. Both PASA (the Payments Association of South Africa) and the banks say so. If you only block the debit, Viva Gym can still treat you as in arrears. On a 12-month option, inside the first 12 months, the terms allow a handover to a debt collector and, if the arrears remain, a listing with credit bureaus. So cancel with Viva Gym first, then deal with the bank.
⚠️ The terms do not publish the name that appears on a bank statement. Match the date and the amount to your membership before you dispute a line. The monthly fee is due on the first business day of the month, in advance, and further attempts are made if the first collection fails. A second debit in the same month is not automatically a mistake. An unpaid debit can also pick up an administration fee. Compare both with your cancellation date.
1. Check what kind of debit it is. Look in your banking app. A DebiCheck debit is one you approved electronically. Older debits may be EFT or registered mandate debits.
2. Go to Viva Gym first. PASA advises taking an incorrect debit up with the company that took the money before going to your bank. Send your cancellation confirmation and ask for a refund of anything taken after your effective cancellation date.
3. Stop future debits. Once you've cancelled, ask your bank (app, branch, or call centre) to suspend/stop the mandate. For DebiCheck, banks like Capitec say you can suspend the mandate to stop future collections.
4. Dispute a wrong debit, and watch the 60-day limit. Since 13 April 2026, the time you have to dispute a debit order is 60 calendar days from the day after the debit went off. Before that it was a much longer window. This applies to EFT, DebiCheck, and registered-mandate debits (PASA FAQ, April 2026).
- DebiCheck debits can usually only be reversed by the bank if the amount differs from what you approved, it went off on a different date, or it's a re-submitted (representment) collection. A DebiCheck debit that matches your approved mandate generally can't be reversed just by disputing it. Then it's a dispute with Viva Gym, and the escalation ladder below applies (FNB/RMB Collections terms, cl. 35; Capitec: types of debit orders).
- Banks warn that disputing a valid debit can have consequences: arrears, handover to debt collectors, and damage to your credit record. Only dispute debits you genuinely believe are wrong.

Escalation ladder
Work up the ladder one step at a time, and keep copies of everything.
- Members area, then email. Cancel in the members area if you can log in, and email [email protected]. Restate the end date and what you want, for example "refund R___ debited on DD/MM; confirm no further debits". The archived contact page said the contact form is answered within 2 working days.
- Registered post, if the members area is unusable. Ground Floor, Block D, Greenford Office Estate, Punters Way, Kenilworth, Western Cape, 7708. This is the notice address in section E. The company's registered office in the same agreement is Mazars House, Rialto Road, Grand Moorings Precinct, Century City, Western Cape, 7441. Send the Kenilworth letter by prepaid registered post and keep the slip. ⚠️ No complaints phone number is published in the terms or the FAQ.
- Your bank for the debit itself: suspend the mandate and lodge a dispute within 60 days if it qualifies. If your bank handles it badly, use the bank's own complaints process, then the National Financial Ombud Scheme (NFO): 0860 800 900, [email protected], nfosa.co.za.
- Consumer Goods and Services Ombud (CGSO) for the contract or cancellation-fee dispute with the gym. It's free and you don't need a lawyer. You must have tried the supplier first. Call 0860 000 272, email [email protected], WhatsApp 081 335 3005, or use the online complaint form via cgso.org.za. The CGSO aims to resolve complaints within 60 business days. Its recommendations aren't binding (CGSO FAQ).
- National Consumer Commission (NCC) if the CGSO process ends without a resolution: 012 065 1940, [email protected], thencc.org.za/complaints. Note on the form that the matter has already been through the CGSO.
- Legal help for larger amounts or a debt-collector handover: Legal Aid SA, a university law clinic, or a private attorney.
